Castleman.\nChattel Mortgage: Description of property.\nA mortgage of \u201c one black mare mule six years old in the mortgagor\u2019s possession in White County, Arkansas,\u201d states facts by which third persons can identify the property, and is a sufficient description.\nAPPEAL from Hempstead Circuit Court.\nC. E. Mitchel, Judge.\nThis is an action of replevin brought in a justice\u2019s court to recover a mule. On appeal to the Circuit Court, the plaintiff offered in evidence a deed of trust executed by one Hill and conveying to the plaintiff an animal which it described as \u201cone black mare mule, six years old.\u201d After describing other property the deed concludes as follows : \u201c All of said property is now in my possession in White County, Arkansas.\u201d The court excluded the deed on the ground that its description of the mule was insufficient. The court also excluded evidence offered by the plaintiff to show that the animal described in the deed was the mule in conttoversy. The judgment was for the defendant, and the plaintiff appealed.\nJ. W. House, for appellant.\nThe description in the mortgage was sufficient to identify the property. Herman Ch.
