Evidence. โ As the worthlessness of the invention patented by appellee is attempted to be proved by the opinions of men who had never seen it tried and who did not attempt to show wherein the patent was defective, the court is of the opinion that even with all the rejected testimony considered, the defense was not made out, and therefore the decree of the court below is affirmed.
