C. Wegner ex rel.\nAbstract of the Decision.\n1. Appeal and error, \u00a7 1410 \u2014when evidence will not he reviewed. A judgment will not be reversed as against the preponderance of evidence unless it is manifestly against the weight of the evidence.\n2. Appeal and error, \u00a7 1632 \u2014how improper remarks of counsel are cured. Improper remarks of counsel will not reverse where the court sustains objections and strikes out the remarks and it does not appear that the remarks influenced the jury.\nA. C. Wegner as informer, against the Mutual Life Insurance Company of New York, a corporation, to recover a penalty for the giving of rebates.
