Hugo Pam, Judge, presiding. Heard in this court at the October term, 1915.\nAppeal dismissed.\nOpinion filed February 14, 1916.\nStatement of the Case.\nTrespass on the case by Max Stricker, plaintiff, against William M. Umbdenstock, defendant.\nJudgment was rendered for plaintiff March 22, 1915. The time for filing the appeal bond was by orders properly entered extended \u201cto and including June 1, 1915.\u201d The bond was not filed until June 2nd.\nFurber & Wakelee, for appellant.\nAdler & Lederer, for appellee.\nAbstract of the Decision.\n1. Appeal and ebbor, \u00a7 671 \u2014when extension of time for filing bond not warranted. Where the time within which an appeal bond is to be filed is fixed by statute, the requirement is mandatory and jurisdictional, and the court from which the appeal is taken cannot extend the time.\n2. Appeal and error, \u00a7 671*\u2014when time for filing appeal bond may be extended. Where a statute requires the court allowing an appeal to fix the time for filing the appeal bond in its order allowing the appeal, the court may, before the expiration of the time so fixed, extend the time for filing.\n3. Appeal and ebrob, \u00a7 1112*\u2014when motion to dismiss for failure to file bond unnecessary. Where an appeal bond is not filed in the time fixed by the court by an extension or otherwise, under a statute requiring the court to fix the time of filing, the appeal must be dismissed and no motion is necessary, the requirement being mandatory and jurisdictional\nSee Illinois Notes Digest, Vols.
