        "text": "JOHN, Judge.\nOn 9 August 1999, plaintiffs filed with this Court a \u201cPetition for Rehearing by Charles G. Monnett, III,\u201d referencing our decision herein filed 6 July 1999 and reported at 134 N.C. App. 1,-S.E.2d -(1999). Pursuant to N.C.R. App. P. 31, the petition is allowed without entertainment of further argument or additional briefing.\nUpon review, this Court\u2019s earlier opinion is modified as follows:\nThe final full sentence on page eighteen of the opinion, commencing \u201c[w]e thus . . . ,\u201d 134 N.C. App. at 15, \u2022 \u2014 \u25a0 S.E.2d at-, is deleted and the following sentence inserted in lieu thereof:\nWe thus specifically declined to address St. Paul\u2019s appeal concerning counsel fees in Hieb II, and as such, our opinion therein is of no effect regarding plaintiffs\u2019 appeal of the counsel fees portion of Judge Winner\u2019s order II.\nAll that portion of the opinion on page twenty-two beginning \u201c[fjinally, on 28 July 1994,\u201d through the conclusion of that paragraph, including citations, 134 N.C. App. at 18,-S.E.2d at-, is deleted and the following language inserted in lieu thereof:\nFinally, on 28 July 1994, the filing date of Judge Sitton\u2019s order, Monnett disbursed the remaining funds, including a check payable to Monnett in the amount of $18,344.66 designated as \u201creimbursement for expenses advanced.\u201d\nExcept as provided herein, the opinion originally filed 6 July 1999 is unmodified.\nAffirmed in part, vacated in part, and remanded with instructions.\nJudges McGEE and HORTON concur.",
