NOTA, in this case it was said by Doderidge, J. that if a passenger lodges three days in an inn successively, the hostler is not answerable for his goods, if they be stolen out of his room. By the ancient law a traveller was so called the first day; for it is not known from whence he came: the second day he is called Hogen Hinde, and the third day a menial servant; and a hostler was heretofore, answerable for him as for his menial servant ill the leet.
