TAYLOR.\n(Decided March 21, 1899).\nCarrying Concealed Weapons \u2014 The Code, Section 1005\u2014 Construction \u2014 Penal Statute.\nIn a penal statute, '1 or \u201d will never be construed. 1! and,\u201d so as to make it more penal. State v. Kearney, 8 N. C., 53.\nINDICTMENT for carrying a concealed weapon, tried before Iiobinson, J., at November Term, 1898, of tbe Superior Court of Lenoie County.\nThe defendant pleaded guilty, and was adjudged to be imprisoned four months and pay a fine of $200 and costs. . The defendant excepted:\n1. That the judgment is \u00e9xcessive and contrary \u201e to the spirit of the Court .and the laxo.\n2. That his Honor erred in imposing both fine and imprisonment.\nDefendant appealed.\nMessrs. Simmons, Pou & Ward, for appellant.\nAttorney General for State."
