Allen Twitty, and others.\n\u00a3>From Rutherford,\nWhere a cause was dismissed without any apparent reason, the judgment was reversed, and the cause remanded.\nAfter the arrest of judgment in this cause, (Jlnte 1 vol. 153,) it continued on the trial docket of the Superior Court of Rutherford, without any entry of the judgment in arrest.\nThe Counsel for the Relators obtained leave to amend the writ and pleadings, at the last Fall Term. And on the last Circuit, before his honor Judge Mangum, amotion was made to dismiss the suit, which was allowed, and the Relators appealed.\nJune, 1829.\nNo entry of the judgment of this Court appeared on the transcript of the record.\nThe case was submitted without argument, by Uuffin, for the Relators, and Gaston, for the Defendants."
