        "text": "Per Curiam.\nUpon an examination of tbe record, we are of opinion that the issue submitted presented the real controversy between the parties and upon the finding in response thereto the plaintiff is entitled to the judgment rendered.\nWe think the controversy almost exclusively one of fact, and we find no error in the record which we think necessitates another trial.\nNo error.",

WILKINSON.\n(Filed 20 September, 1911.)\nIssues \u2014 Real Controversy.\nIn this action by a contractor for balance due for constructing a building, the issue submitted presents the real controversy, and no error is found.\nAetjeal from Ferguson, J., at March Term, 1911, of Pitt.\nThis was a suit for the balance due on a contract for the construction of a building. \u2018 The contentions of the parties appear in the pleadings. There was a verdict and judgment for the plaintiff, and the defendant appealed to this Court.\nThis issue was submitted:\n1. Was the building completed according to contract ? Answer: Yes.\n8. J. Everett for plaintiff.\nJulius Brown for defendant."
