The Defendant pleaded in abatement, that there were other executors not named in the. writ.

The pica is bad — it should have stated (has those oilier executors were qualified as executors, and took upon them-élves the burthe > of executing the will, as stated in the Office of Executors, 42, 43. The plea was overruled. "
