ALARKA LUMBER COMPANY and ALARKA VALLEY RAILWAY COMPANY.\n(Filed 19 September, 1934.)\nCivil action, before McElroy, J., at March Term, 1934, of Swain.\nThis was an action of ejectment, tried upon the following issues:\n1. \u201cAre the plaintiffs the owners of and entitled to the possession of the lands described in their complaint ?\u201d\n2. \u201cDid the defendant Alarka Lumber Company wilfully trespass upon said lands?\u201d\n3. \u201cDid the defendant Alarka Valley Railway Company wilfully commit trespass upon said lands?\u201d \u2022\n4. \u201cWhat amount of damages, if any, are the plaintiffs entitled to recover ?\u201d\nThe jury answered the first three issues \u201cYes,\u201d and the fourth issue \u201c$75.00.\u201d\nFrom judgment upon the verdict the defendants appealed.\nEdwards & Lealherwood for plaintiffs.\nMoody & Moody for defendants."
