BASINGER.\n(Filed 9 June, 1937.)\nAppeal and Error \u00a7 38\u2014\nWhere the Supreme Court is evenly divided in opinion, one Justice not sitting, the judgment of the lower court will be affirmed, in accordance with the usual practice.\nAppeal by plaintiff from Armstrong, J., at November Term, 1936, of RoceiNgham.\nAffirmed.\nThis is an action to recover damages for the unlawful arrest and wrongful imprisonment of the plaintiff, procured, as alleged in the complaint, by the defendant.\nAt the close of the evidence for the plaintiff, the defendant moved for judgment as of nonsuit. The motion was allowed, and plaintiff excepted.\nFrom judgment dismissing the action as of nonsuit, the plaintiff appealed to the Supreme Court.\nSharp & Sharp for plaintiff.\nCarlis T. Kennedy for defendant."
