CARL GOERCH and \u201cTHE STATE,\u201d a Magazine.\n(Filed 28 September, 1938.)\nAppeal by plaintiff from Williams, J., at June Term, 1938, of Halifax.\nCivil action for libel.\nDecision on former appeal is reported in 209 N. C., 741, 184 S. E., 489.\nThe allegations and evidence are sufficiently stated there. A repetition of them is unnecessary here. On the retrial below the jury answered these issues in the affirmative: \u201c(1) Did the defendant publish of and concerning the plaintiff the article as alleged in the complaint? (2) If so, was it true?\u201d Other issues were not answered.\nFrom judgment thereupon for defendants, plaintiff appealed to the Supreme Court, and assigns error.\nGulley & Gulley for \u25a0plaintiff, appellant.\nBunn \u25a0& Arendell for defendants, appellees."
