Timothy Williamson.\nFrom Cumberland.\nIndictment charged Defendant with \u201c feloniously stealing, taking, and \u201ccarrying away, a certain Bank note, issued by the Bank of Newbern.\u201d The note offered in evidence upon the trial, purported to be issued by \u201cThe President and Directors of the Bank ofNewbern.\u201d The Defendant was acquitted, because the evidence did not support tire charge. He was then indicted \u201c for feloniously stealing, talcing, and carrying \u201c away, a certain Bank note, issued by the President and Directors of \u201c the Bank of Newbern.\u201d To this indictment he pleaded \u201cformer \u201c acquittal,\u201d and, to support the plea, produced the record of the 'first indictment, and the proceedings had thereon. Held, that\nThe record produced does not support the plea, and the plea overruled.\nAt March Term, 1816, of Cumberland Superior Court, the Defendant was indicted for \u201c feloniously stealing, tak- \u201c ing, and carrying away, a certain Bank note, issued by \u201c the Bank of Newbern, bearing date the 6th day of No- \u201c vember, in the year of our Lord one thousand eight hun- \u201c dred and nine, subscribed with the name of James (S M\u2019Kinlay, President, and M. C. Stephens, Cashier, for \u201c the payment of four dollars to G. Curry, or bearer, on 6\u2018 demand, the said Bank note being then and there of the \" value of four dollars, and being the property, goods and \u201c chattels, of John Ray, and the money therein mentioned, \u201c payable and secured by the said Bank note as aforesaid, \u201c then and there being due and unsatisfied, to the said <e John Ray, the proprietor thereof, against the form of \u201c the statute in such case made and provided,\u201d &c.\nThe Bank note offered in evidence upon the trial of the indictment, was in the following words and figures, to-wit ;\n\u201cNo. 413. D. 4.\n, H? o *\n\u201c The President and Directors of the Bank of Newbern, promise \u201c to pay G. Curry, or bearer, on demand, four Dollars, Newbern, the 6th day of Nov. 1809.\nPOUR.\n\u201c M. C, STErnOTs, Cash\u2019r. Jas, M\u2019JKikxat, Pres.\u201d\n\u00d3n bebalf of the Defendant, it was insisted, that as the Indictment charged him with feloniously stealing, taking, and carrying away, a Bank note \u201c issued by the Bank of Newbern,\u201d and the note oifered in evidence, purported to be issued by \u201c the President and Directors of the Bank of Newbern,\u201d the evidence did not support the charge; and of this opinion was the Court, and the Defendant was acquitted.\nAt September Term, 1817, the Defendant was indicted \u201c for feloniously stealing, taking, and carrying away, a \u201c certain Bank note, issued by the President and Direc- \u201c tors of the Bank of Newbern, of the Number 413, letter \u201c D, dated Newbern, the sixth day of November, in the \u201c year of our Lord one thousand eight hundred and nine, \u201c subscribed with the name of James M\u2019Kinlay, Pres\u2019t.\u201d &c. pursuing the description as given in the preceding indictment.\nTo this indictment the Defendant pleaded \u201c former \u201c acquittal,\u201d and the Solicitor for the State replied, \u201c mil \u201c tiel record.\u201d And the record of the first indictment, and the proceedings had thereon, was offered in support of the plea. The Court was of opinion, that the record produced did not support the plea; and the Defendant appealed."
