        "text": "OPINION OP THE COURT.\nPARKER, J.\nThis cause was tried and resulted in a verdict of guilty of murder in the third degree. The defendant appealed to this court, and the cause was reversed and remanded. 10 N. M. 138.\nThe indictment charged murder in the first degree upon which a conviction might be had in either the first, second or third degrees. After the cause was remanded, defendant interposed a plea of autrefois acquit as to the first and second degrees of murder charged. The Territory demurred to the plea which demurrer was overruled. The Territory then appealed to this court and seeks to review the judgment on the demurrer.\nAside from the question of the right of the Territory to appeal at all in cases not specified in the statute (Compiled Laws, sec. 3411), it must be apparent that this judgment is not a final judgment and is therefore not appealable. Jung v. Myer, 68 Pac. (N. M'.) 933.\nThis court having no jurisdiction of the cause the appeal will be dismissed, and it is so ordered.\nMills, G. J., McPie and Baker, JJ., concur.\nMcMillan, J., having tried the cause below, took no part in this decision.",

McMillan, Associate Justice.\nAppeal dismissed.\nEdward L. Bartlett, Solicitor-General, and George W. Pritchard, District Attorney, for appellant.\nIn this Territory while the Supreme Court may affirm, reverse or modify a judgment of the lower court, or render such judgment as that court should have rendered in a civil case \u2014 in a criminal appeal this court\u2014 \u201cif the judgment be reversed, shall direct a new trial, or that the defendant be absolutely discharged, according to the circumstances of the case.\nCompiled Laws 1897, sec. 3416; Compiled Laws 1897, sec. 3418.\nThis last section was construed by this court in Territory v. Griego, 8 N. Belden, 33 Wis. 121, 14 Am. 748.\nBut a verdict of murder in tbe second degree is only an implied acquittal of murder in tbe first degree; and if tbe verdict from which tbe inference is drawn is set aside, nothing remains to sustain tbe inference and tbe verdict and its incidents fall together, and tbe indictment is left to stand as to tbe crime of which accused was convicted, as though there had been no trial.\nBailey v. State, 26 Ga. 579; State v. Behi-mer, 20 Ohio St. 572; United States v. Harding, 1 Wall Jr. 147; State v. Kittle, 2 Tyler 471, is not to the contrary.\nBy taking exceptions and ashing for a new trial, the defendant is deemed to have waived his right to immunity from further jeopardy, in case a new trial is granted.\nPeople v.
