        "text": "OPINION OP THE COURT.\nROBERTS, C. J. \u2014\nThe question now before the Court arises upon a motion filed by appellee to affirm the judgment of the trial court, because of appellant\u2019s failure to file briefs within the time prescribed by the rules of the Court. Appellants\u2019 time expired on the 15th day of October. The motion was filed on the 29th day of the same month. However, the clerk of the Court received appellant\u2019s briefs by the same mail, and at the same time appellee\u2019s motion was received. Consequently, at the time the motion was filed, appellant was not in default, as his briefs were in the hands of the clerk, and he had cured the default before advantage had been taken of the same. The motion to affirm the judgment will, therefore, be denied, and it is so ordered.\nJustice Hanna being absent from the State, did not participate.",
